General
Can all court document lodgment be submitted electronically through eServices?
Currently, only the following document types can be lodged through JusticeLink eServices:
- Statement of Claim – no listing
- Affidavit of Service
- Notice of Motion for Writ - Levy of Property
- Notice of Motion for Default Judgment - Liquidated
- Notice of Motion for Garnishee - Wages or Salary
- Notice of Motion for Default Judgment - Possession of Land
- Notice of Motion for Writ of Possession
- Court Documents (General Form)
Registered users of JusticeLink eServices will be advised when further documents become available electronically.

Can I keep using my bulk allocated numbers?
No, bulk allocated numbers can no longer be used. The new JusticeLink eServices process provides a faster and more efficient process for lodging documents in bulk.

How do I gain access to my matters currently active in the Courts?
It will be possible to gain view access to existing cases in all jurisdictions after registration for eServices, where your PCN (Practicing Certificate Number) is linked to a case.

How will I be kept up-to-date of any changes in eServices?
If you have subscribed to JusticeLink eServices we will keep you up to date via email. Additionally, updated information is regularly posted on our website.

If I am delegated full access by my Legal Practitioner, will I have access to their other matters as well?
A Delegate of a Legal Practitioner or an Authorised Officer is granted viewing permissions (of the entire case load) as a minimum. Therefore you will be able to view all their matters. A Delegate can be granted additional permission to upload documents.

What is the cut-off time for the daily request to be uploaded?
There is no cut-off time for uploads to JusticeLink eServices. Uploads can be made 24 hours a day, seven days a week. Documents must pass final acceptance with JusticeLink eServices prior to midnight to be lodged on that day. All returned documents are date and time stamped. However, JusticeLink eServices technical support is only available Monday to Friday 9:00am to 4:30pm.

How do I change the Solicitor's address? The incorrect address displays on the Statement of Claim document.
To change the Solicitor on Record's address, complete the 'Notice of Change Address of Solicitor' form (Form 76 available here http://www.lawlink.nsw.gov.au/lawlink/spu/ll_ucpr.nsf/pages/ucpr_forms ) and lodge it over the counter at a Registry. Once the JusticeLink records are updated the change will reflect in JusticeLink eServices and on any documents produced after the change has taken effect.

We have a number of files that need to be served interstate, will the Local Court serve the documents for us?
No. The Local Court does not serve documents interstate. You will need to contact an interstate process server to serve these documents for you. Where the party is located interstate a FORM 1 notice needs to be attached to the originating process. Form 1 should be printed by the filer from their offices and attached to the Statement of claim prior to services. FORM 1 is not supplied by eServices.

Where a Party to the case is a sole trader / proprietor of a registered or unregistered business, how do we denote their business details, ie. Trading as ABC Traders?
You should include the business name (Trading As) as part of the Surname (for an individual) or as part of the Organisation name (for an organisation). For example ‘Bloggs, T/A Bloggs Plumbers’.

Search / View JusticeLink eServices
Can I search for a document by case number?
You can search for a document in JusticeLink eServices using the JusticeLink Case number or your own Reference Number. There are search fields on your Home Page and the Your Filed Documents page.
NOTE: You can only search for your own cases.

When an initiating document is filed via JusticeLink eServices, will I be able to see the secondary documents if they are lodged via the registry?
Yes. All documents associated with a case can be viewed within eServices irrespective of whether they are lodged via eServices or at the registry.

I am a Delegate to two people. How do I view their separate caseloads and file documents on their behalf?
When you logon to JusticeLink eServices a “Managing cases for” drop down box is displayed on the right hand side of the screen. Select the JusticeLink eServices user you are a Delegate for; you will then be able to view and file documents on their behalf. You can only view and file documents on behalf of one person at a time.

We are unable to find information on matters that were initiated prior to JusticeLink eServices. What can we do?
Your historical data is not immediately available in JusticeLink eServices. We can migrate this data across for you. Contact JusticeLink eServices Support at courts_eservices@agd.nsw.gov.au and advise which matters you wish to have transferred to eServices.

My eUser type is a Delegate but I cannot see any cases in JusticeLink eServices
Ensure you have been attached as a Delegate to your Legal Representative or Authorised Officer. You will not be able to do anything as a Delegate unless you are attached to a Legal Representative or Authorised Officer. When you logon to JusticeLink eServices a "Managing cases for” drop down box is displayed on the right hand side of the screen. Select the JusticeLink eServices user you are a Delegate for; you will then be able to view and file documents on their behalf.

Registration
Can we use the one user ID and password for multiple staff members?
No. Each individual user must have a separate ID and password and be attached to your eOrganisation. Your Administrator will allocate permissions and add or cancel staff access to the system. You must all apply for individual accounts and register for JusticeLink eServices individually.

I have sent my eOrganisation Agreement to JusticeLink eServices support, why am I not set up?
Registering for JusticeLink eServices is a multi-step process, please contact JusticeLink eServices Support at courts_eservices@agd.nsw.gov.au so we can help you.

What does it mean when I get an error message “Although you are registered in our system your linkage to an organisation is not found and therefore you are not authorised to access eServices”?
The error message means that you cannot access the JusticeLink eServices website until you are associated to an eOrganisation. You can be associated to an eOrganisation either by being added to an existing eOrganisation by your Administrator or by selecting the Register Organisation menu option to create a new eOrganisation in JusticeLink eServices. You must ensure an eOrganisation has not been created for your Organisation prior to creating one.

When I try to create my email address it keeps getting rejected, why does this happen?
Are you using an apostrophe or including a space before or after your email address? JusticeLink eServices does not accept email addresses with an apostrophe or blank spaces. Please create a new email address or ask your IT Developer/Provider to create an alias on your mail server.

How long does it take to upload a Statement of Claim?
The document upload process is almost instant.

How long does it take to get a signed / sealed Statement of Claim?
The moment a successful electronic lodgment is received and validated by JusticeLink eServices you will receive an electronic signed and sealed PDF Statement of Claim. If you are lodging a large batch of documents it will take slightly longer for all the Statements of Claim to be returned.

What is the time delay between when we enter the details and when we can collect documents?
You can print/save the document on-line and therefore it is real-time once the upload procedure is successfully completed

Can I still file my documents across the counter?
Yes, but pre-allocated numbers will no longer be available. If you have more than five documents to file per day, you will have to leave them with the Registry staff for processing and collection.

Do I still need to take printed copies of documents to the counter?
No. JusticeLink eServices allows documents to be lodged electronically. Any documents that are not currently available through JusticeLink eServices will still have to be lodged over the counter.

Do I need to have my documents signed?
Yes. Any original documents that currently require signatures must be signed and stored in your office. The original signed document must be produced if requested by the court.

I have lodged a document but I cannot see the case on my Home Page, why?
To view a case, you must be a party to the case or be a Delegate of a party on the case. There may be slight delays depending on IT resource usage at the time of lodgment.

If I make daily document lodgments through the website, can I also cancel them online?
No. Document lodgments cannot be cancelled through the website.

How do I manage my electronically lodged documents?
You will need to consider how you will manage your electronic files across individuals and locations within your organisation to ensure access to these documents is available for everyone who needs it. The returned sealed PDF document is only accessible by the person who loaded the batch. An email is sent to that person containing details of all the documents in the batch and the sealed PDF files. These can be downloaded to your own server if required.

Statements of Claim
How do I attach supporting documents to a Statement of Claim?
You can attach a supporting document to a Statement of Claim by annexing a PDF document when you upload the Statement of Claim.
Please note: After a document has been annexed and submitted, it cannot be removed from JusticeLink eServices.

How do I get my Statement of Claim?
To access your Statement of Claim, log in to JusticeLink eServices and download your file. The sealed and dated Statement of Claim will be available in PDF format from your batch job as well as in the automated email sent to the person who lodges the documents. Details of the Statement of Claim can be viewed by the Solicitor on Record / Authorised Officer or their Delegate.

When making two separate claims against one Defendant, is it necessary to submit two XML files?
Yes. Two separate documents (XML files) must be lodged if there are two separate claims. Each claim is managed as a stand-alone case by JusticeLink eServices.

Do I need to file an Affidavit Verifying when I lodge a Statement of Claim in the Local Court?
No. A Statement of Claim filed in the Local Court does not require an Affidavit Verifying.

Currently affidavits are attached to Statement of Claim. Is this required to be sent to the courts?
Affidavits verifying must be lodged in the Supreme and District Courts and hard copies provided, if requested by the court. Affidavits can be annexed as a PDF when uploading the Statement of Claim.
Affidavits are not required to be sent to the Local Court.

What does 'Service by Post' mean?
It means a Court registry serving a Statement of Claim by post.

When I select 'Service by Post' in Local Court, when will I be notified?
No, a Statement of Claim is deemed to be served on the 4th business day from the date of lodgment of Statement of Claim.

Will Service by Post be electronic?
Service by Post will be mailed through Australia Post, as per the current practice.

Why do I get charged two service fees (by post) when both Defendants reside at the same address?
The fee for service by post in the Local Court Civil Jurisdiction is one fee per Defendant per address. Accordingly, if there are two Defendants residing at the same address there are still two fees payable.

Affidavit of Service
When to file an Affidavit of Service?
If the "Method of Service" in the Statement of Claim is selected as "SELF" you MUST file an Affidavit of Service when applying for a Notice of Motion for default judgment (Part 16.3 (2) of the Uniform Civil Procedure Rules 2005). The affidavit of Service can be filed either prior or together with the filing of the Notice of Motion for Default Judgment. The electronic filing of the Notice for Default Judgment DOES NOT dispense with the filing of the Affidavit of Service.
If the "Method of Service" in the Statement of Claim is selected as "POST", the filing of the Affidavit of Service is NOT required as the service of the Statement of Claim is affected by the Local Court Registry.
Notices of Motion
When will I be able to lodge a NOM Garnishee by eServices?
Functionality for lodging Notices of Motion for Garnishee - Wages or Salary became available on 1 November 2010.

Can a Notice of Motion for Default Judgments and a Garnishee be electronically lodged together?
No. A Default Judgment order has to be recorded in JusticeLink before the NOM for Garnishee can be electronically lodged.

How soon will judgment be entered after lodging Default Judgment?
Notices of Motion (NOM) for Default Judgment will be processed within 48 hours of the lodgment date.

Writs
Where we need to file a Notice of Non Compliance (NONC) as well as a Writ, what is the best option as the Writ is filed on-line but the NONC is not available as an XML form? Will the Writ get rejected?
If there is an instalment order in force, the Notice of Motion for a Writ for Levy of Property will not be rejected. The XML contains provisions to answer questions relating to the instalment order and the stay. The Notice of Non Compliance can be annexed as a PDF attachment to the Writ XML or lodged manually at the registry.
All system validations are done on the Writ XML so the Affidavit section relating to the stay must be completed.

JusticeLink eServices Tax Receipts
When a payment is received for document lodgment, JusticeLink eServices will issue a Tax Receipt that can be printed. JusticeLink eServices will only display the last 2 months Tax receipts.

How can I pay for electronic document lodgment?
JusticeLink eServices payments can only be made by credit card. We are unable to process payment made by cheque or debit card.

If I make an error, how long will it take to receive a refund?
Most refund claims will be processed within ten (10) business days of receipt of a correctly completed application. The refund application details are here.

Refunds will be made via Electronic Fund Transfer. Bank details must be provided when making the refund application.

How can our IT department assist in the transition to JusticeLink eServices?
Your internal IT department should use the XSD files provided to produce a data entry screen for you to capture case information. Please refer to the technical overview documentation for more details. Your system output must be an XML file that complies with the schema.

Will we receive a return XML file containing the accepted document information, including the case number, or will we receive a PDF version of the document?
Once an XML file is successfully uploaded into JusticeLink eServices, you will have access to both Statement of Claim (in PDF format) and your input XML file. The XML file is in fact the same file that you initially uploaded.

The schema does not contain options for Search Fees, or other claimable disbursements. Where should these amounts go?
Search Fees or other claimable disbursements should be included in the Pleadings Details fields.

Can we send multiple cases within each XML file? For example, can I send details of two Statements of Claim in one file?
No. Each each document / form requires a separate XML file. However, you can lodge up to 100 XML files in a batch.

The Test site doesn’t have a 'Trusted Site' certificate. Is this available in the Live system?
The Live system uses VeriSign SSL.

If we use Word files from the LawLink site to produce documents, such Statement of Claim, can we save these as XML files to upload to JusticeLink eServices?
A Word file that is just 'Saved as' an XML file will not validate correctly if you attempt to upload it to JusticeLink eServices. All XML files must be based on the XSDs (schemas) and comply with the guidelines outlined in the technical overview document.

What is a Batch?
A Batch is a number of files that are grouped together and are processed by an IT system as a single unit (also known as a batch job). A batch of up to 100 XML files can be uploaded to JusticeLink eServices at a time. This is much faster than uploading individual files.

An XML schema defines the structure of an XML document, such as which data elements and attributes are accepted in a document and how the data elements relate to one another. The schema is the basis on which the XML file is built.
